Common prosperity is not only an issue in the economic and social fields but also deserves attention in the field of education.The realization of common prosperity in education is conducive to the promotion of fairness and justice and it embodies the essenceof Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era. However the uneven distribution of educationalresources in China has a long history coupled with the lack of institutional resource allocation such as constitutional litigation and interpretationmaking the guarantee of the rule of law for common prosperity in the field of education still lacking. Faced with the challengesof achieving common prosperity in the field of education in China it is necessary under the guidance of Xi Jinping's ideologyon the rule of law to redefine the connotation of “equal right to education” in the Constitution. In terms of normative construction itshould be based on the “ uman rights guarantee” stipulated in Article 33 3 of the Constitution with the “ qual rights” specified inArticle 33 2 and the “ ight to education” in Article 46 forming the two wings thus forming a stable “ in-shaped” framework. At theinterpretive level the constitutional expression of common prosperity in the field of education namely the “ qual right to education” norm should be deeply combined with relevant legislative and judicial processes in practical application providing a solid institutionalguarantee for the realization of common prosperity in the field of education.
